Water funding bill passes with restrictions on F-M diversion funding

The Legislature has given final approval to the budget for the state Water Commission – that contains what House Majority Leader Al Carlson (R-Fargo) called “softer language” on the proposed F-M diversion.

Earlier in the session, Carlson sponsored an amendment that would have prohibited any state money from being spent on the diversion project until the federal government authorizes the project. Carlson says the new language worked out in conference committee is softer, but still has some hoops for the diversion project.

"Federal authorization, a project partnership agreement, a federal appropriation provided for project construction, and approval by the state Water Commission," said Carlson. "The language is softer, but it's along the same lines as before -- we need federal involvement for that project."

Rep. John Wall (R-Wahpeton) says the diversion project needs more study.

"This proposed legislation could potentially allow for one of the largest private property takings in the history of our state," said Wall. "I do not think this is the North Dakota way. I do not think this is what neighbors do to neighbors."

The bill is on its way to Gov. Dalrymple.
