A hearing will be held in state district court in Fargo next month on a settlement the North Dakota Public Service Commission reached with a Mentor, Minnesota – based seed company.

Anderson Seed had been declared insolvent in February 2012. The company dealt in sunflower seeds.  It had a processing plant in Redfield, South Dakota – which it shut down without paying farmers for their seed. North and South Dakota farmers claimed they were owed $5 million in unpaid seed deliveries.

PSC asks court to declare Harvey elevator insolvent

The Public Service Commission is asking a district court that a Harvey based elevator be declared insolvent – and the PSC to be named trustee.

Earth Harvest Mills has been operating under the name Dakota Prairie Organic Flour Company. Commissioner Randy Christmann says the company has been in financial trouble for some time – and the PSC has had a number of meetings with the company to try to turn things around. 

"However, it doesn't seem to be turning around," said Christmann. "Waiting further would probably increase the likelihood that bad things might happen."
