A simple assault charge against state school superintendent Kirsten Baesler has been dismissed.
Baesler had been arrested February 15th on suspicion of simple assault. Her former fiancé, Todd Tschosik (show-sick), reported that Baesler had assaulted him at his home early that morning. Police say Tschosik had a visible injury, and there was dried blood on his face.
Bismarck City Attorney Paul Fraase (fray-see) says two other people were present at Tschosik’s home that night. He says they reported Baesler did throw something at Tschosik – but neither could say if the object hit him. Fraase says the case was ready to be transferred to district court for trial – but he decided he didn’t have enough evidence to convict her. So he asked that the charges be dismissed.
Simple assault is a class “B” misdemeanor. It carries a maximum 30 days in jail and a $1500 fine.
